In continuation of revious correspondence

on the subject of the Rule of Court made on 7th. December last, altering the "acations of the Court, I have now the honour to inform Your Excellency tha: I do not propose to ask Your Excel -lency to submit it to the Legislative Council, and I therefore have the honour to ask Your Excellency to return it to lê.

The reason which has led me to withdraw the ule is that while both branches of the profession are unanimous -ly agreed as to the advisability of extending the vacation, there are two points on which they are not agreed: the first is not serious, the period at which the vacation should comience: the second is serious, the Solicitors desire to have a "right of audience" during the new Lone Vacation: the Bar think that the re-enactinght an old provision of the law would neet all the necessities of the case, as this would give a right of audience

in the absence of counsel. The Solicitors in their turn think

that this is insufficient. In view of this disagreement on 80 important a matter between the two branches of the profession, I do not think it would be advisable to proceed in the matter, without seeking the advice of the Secretary of State.

The question which I now desire to submit

for the consideration of the Secretary of State being purely

personal to the Chief Justice, who up to the present time has been somewhat curiously omitted from consideration, I propose

to omit all reference to the discussions which have arisen in

connexion with the action of the Chamber of Commerce in the

Excellency

matter.
